Will The Same-Sex Marriage Ruling Be Overturned?

The US Supreme Court will meet today to decide whether to take up the appeal from Kim Davis, the woman who famously refused to sign the first same-sex marriage license in Kentucky. She is hoping that the high court will take up the appeal in an attempt to overturn the decision in Obergefell v. Hodges that allowed same-sex marriage across the United States.

I suspect that, after the overturning of Roe v. Wade, the justices are loath to look at or overturn another progressive “win” so soon. This follows the idea that so many of these types of relationships have been affirmed; to change it would be difficult.

One of the factors the Supreme Court considers when weighing the possibility of overturning a precedent is whether Americans have come to rely on the decision. In the case of same-sex marriage, those considerations could include factors like child custody and financial planning.
