Should Abortion Be Left Up to the States?

Before 1973, Abortion was something that was regulated by the States, just as was birth control and other social issues. The United States Supreme Court brought it to a federal level by ruling that Roe had the right to an abortion and in the Casey ruling, a test was set in place that stood until 2022, when the Court ruled in Dobbs that the power should go back to the states– overturning Roe and Casey.

Republicans are in disarray, with many taking the fight to the various states, and others trying to push for a federal ban on the procedure at a set number of weeks. The country, which is still divided on the issue, was shocked by the Dobbs ruling, making it easy to whip people up to support anything that seemed like what they had under Roe.

But here we’re asking the question: should this be a federal measure or left up to the states?

The answer is that it should be both. Just as murder is both a federal crime and a state crime, I don’t believe that the federal government can get away with saying something about the practice. Does the country think that there’s any limit to when a child can be killed in the womb?

Trump, being the most pro-life President post-Roe, should take a page from Doug Wilson, and push incrementalism at the Federal level, and the people should work at all levels. This means that we should start by figuring out what is wildly popular in terms of restrictions on abortion that could be made at the federal level– whether that’s a ban in the third trimester, with some exceptions, or whatnot. I’d tie the ban to enforcing a gathering of statistics– what were the reasons for the abortion, etc.

Then, having the psychological victory of getting some ban in place, we work at ratcheting that down, using the metrics and science until we get to no abortion, if that’s feasible– or to 15 weeks or 6 weeks, whatever works.

The reason for this is that there will be states, absent a federal ban, that will have abortion up until birth. There will be all sorts of rulings in place, and as someone who believes abortion kills an individual, I’m up for anything that saves a life, and I’m a realist to understands that the possibility of getting abortion 100% banned tomorrow as part of your platform ensures you will not be elected to office to be able to carry that out.

This needs to be war, not a single skirmish.
